1.     APPLICATION OF TERMS

These terms apply to any person or entity (‘you/your’) accessing ‘our/the website’.

This website is owned and operated by Visit Rural Pty Ltd ACN 663 928 890 (‘we/our/us’).

By accessing and using our website you agree to be bound by these terms. We may amend these terms and conditions from time to time.

These terms are governed by the laws of Australia.

We will handle all personal information we collect in accordance with our privacy policy and the applicable law. Our privacy policy explains:

(b)        How you can lodge a complaint regarding the handling of your personal information,; and;

3.     SERVICES

Our website offers an online platform that allows you to search for and book the services. The services offered are those displayed on our website. We may from time to time refer to those who offer services on our website as “Vendors” or “Hosts” and those who avail of the services as “Guests” or “Visitors”.

We reserve the right to amend the range and prices of our services at any time.

All services are subject to availability. We will inform you as soon as possible if the product or service you have ordered is not available.

Visit Rural reserves the right to not host political and social justice events. Sign up applications may be rejected if Visit Rural deems an event to be political or social justice in nature.

4.     BOOKING

When you book our service, you agree to pay all charges listed on the booking including the listing price and any applicable fees such as a cleaning fee, taxes, or any other charge noted on the listing as may be from time to time necessary.

You agree that we may use the credit card details you have provided to our secure, third-party payment provider, Stripe to charge your bank account on behalf of Visit Rural.

When the payment is authorised by your bank, you will receive a booking confirmation which acts as a contract between you, the Guest, and the Host, who offers the service.

You will be deemed to have accepted our Customer Terms and Conditions and all of the policy documents contained within the “Legal” section of our website.

5.     PAYMENT

      By proceeding with your booking and selecting the payment method labelled "Stripe," you hereby authorise Visit Rural to process your payment through Stripe, a third-party payment gateway service provider, for the total amount of your booking, including any applicable taxes, fees and credit card surcharges. You acknowledge and agree to the following terms:

(a)   Payment Processing: You understand that by selecting Stripe as your payment method, your payment information will be securely transmitted to and processed by Stripe. Stripe's payment processing is subject to its own terms and conditions, which you must review and accept separately during the payment process.

(b)   Payment Security: We take the security of your payment information seriously and employ industry-standard security measures to protect it. However, you acknowledge that no online payment system is entirely immune to risk, and you agree to use Stripe at your own risk.

(c)   Payment Confirmation: Once you complete the payment process by clicking the "Pay Now" button, you acknowledge that this action serves as your explicit authorisation for you to initiate and process the payment transaction through Stripe. This authorisation is final and cannot be revoked after the transaction is completed.

(d)   Payment Disputes and Refunds: Any payment disputes, chargebacks, or refund requests related to your booking should be directed to Visit Rural in accordance with our Refund and Cancellation Policy. You understand that we will handle such matters in compliance with our policies and may involve Stripe as necessary.

(e)   Termination of Authorisation: You may terminate this authorisation by choosing an alternative payment method or discontinuing the booking process before confirming the payment through Stripe. Please note that if you proceed with the Stripe payment, you are consenting to the terms and conditions outlined herein.

(f)    By selecting Stripe as your payment method and proceeding with the booking, you confirm that you have read, understood, and agreed to the terms of this Payment Clause. If you do not agree with any part of these terms, please select an alternative payment method or refrain from making the booking. To proceed with the payment on the website, tick the box and confirm the approval to pay statement.

6.     RIGHTS

Should you, or any member of the booking, stay longer than the booking permits, your Host has the right to charge additional fees for overstay

7.     REFUND AND CANCELLATION POLICY

By using the Visit Rural website , you agree to our Refund and Cancellation Policy in the “Legal” section of the website.

8.     INTELLECTUAL PROPERTY

Our website and its content including our services, may represent or contain intellectual property owned by our hosts or us, including trademarks, copyrights and proprietary information.

You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the intellectual property on our website, in whole or in part, without our prior written consent.

9.     PROHIBITED

Visit Rural does not allow, during your booking, any illegal activities to be carried out or other behaviours that could harm the products, services or reputation of the Host or us. We specifically prohibit the following:

(a)   Sexual exploitation;

(b)   Human trafficking;

(c)   Pornography;

(d)   Illicit drugs;

(e)   Drug production, cultivation, manufacturing or distribution, and;

(f)    Any other criminal acts.

10.  DISCLAIMERS

To the extent permitted by law, we have no liability or responsibility to you or any other person for any loss. You acknowledge that you access and use our website at your own risk.

We make no representation or warranty that the website is appropriate or available for use in all countries or that the content satisfies the laws of all countries. You are responsible for ensuring that your access to and use of the website is not illegal or prohibited, and for your own compliance with applicable local laws.

By continuing to use our website and services, you acknowledge that we cannot guarantee any particular results, as such outcomes are based on subjective factors that are not within our control. Therefore, following any information or recommendations provided by our website and services is at your own risk.

We are not liable to you or anyone else if interference with or damage to your computer systems occurs in connection with the use of this website or a linked website. You must take your own precautions to ensure that whatever you select from our website is free of viruses or anything else that may interfere with or damage the operations of your computer systems.

Visit Rural Pty Ltd will not be liable for any accidents or injuries that occur on any vendors' premises from any customer that has booked via the Visit Rural website. The Vendors must have appropriate Public Liability insurances and customers are encouraged to purchase travel insurance prior to travelling to their event or holiday.

11.  ACCEPTABLE USE POLICY

You must not use our website in any way that we deem to be inappropriate or unlawful, including but not limited to:

(a)        Any breach of privacy or any infringement upon the legal rights of any other person;

(b)        Defamation;

(c)        Uploading any virus, malware or other malicious software;

(d)        Posting, commenting or otherwise transmitting any unauthorised material including, but not limited to any material that is or is likely to be defamatory, racist, obscene, threatening, pornographic or otherwise deemed by us to be unacceptable.

12.  SUSPENSION AND TERMINATION

Without prejudice to any other right or remedy available to us, if we consider that you have breached these terms or we otherwise consider it appropriate, we may immediately and without notice, suspend or terminate your access to the website, or any part of it.

13.  GENERAL

These terms, and any dispute relating to these terms or the website, are governed by and must be interpreted in accordance with the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Queensland, Australia, in relation to any dispute connected with these terms or the website.

For us to waive a right under these terms, the waiver must be in writing.

If any part or provision of these terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as severed from these terms. The remainder of these terms will be binding on you.
